We are seeking an experienced Canadian Patent Agent (Of Counsel) for a contract-based, hybrid role in the Greater Toronto Area, Canada, with flexibility for remote work.The Patent
Agent will be responsible for preparing and prosecuting patent applications, conducting patentability and prior art searches, and providing strategic counsel on patent law. The role also involves advising clients on intellectual property matters, with a focus on helping them secure and manage their patent portfolios effectively. The successful candidate will collaborate directly with clients and team members to ensure top-tier legal service.The Patent Agent (Of Counsel) will act as the firm’s designated patent agent of record before the Canadian Intellectual Property Office (CIPO), the College of Patent Agents and Trademark Agents (CPATA), and related international authorities. This role requires a deep understanding of Canadian patent law, strong client management skills, and experience with patent prosecution and enforcement strategies.
This is an independent counsel role (Of Counsel / Contract / Part-Time role) with responsibility for managing patent matters and supporting business development in the IP space.
Required Qualifications
- Expertise in patent preparation and filing of patent applications.
- Strong knowledge of patent law, patentability, and related legal framework.
- Experience in conducting comprehensive patent searches to assess prior art and originality.
- Excellent analytical and problem-solving skills with attention to detail.
- Ability to work independently and collaboratively in a hybrid work setting.
- Registered as a patent agent in Canada and/or the United States in good standing.
- Experience in intellectual property and a strong understanding of IP systems.
- Capability to communicate complex legal concepts clearly and effectively to clients.
- Minimum of 5+ years of Canadian patent practice experience.
- Familiarity with international patent laws and systems (Madrid, EUIPO, USPTO) would be an asset.
- Patent litigation experience is a plus.
- A proactive, business-minded approach to legal problem-solving.
